Nevada Joins 24-State Coalition Opposing HUD Rollback

Nevada Attorney General Aaron D. Ford joined a coalition of 24 state attorneys general on Thursday in opposing a proposed rollback of regulations under the federal Fair Housing Act, sending a comment letter to the U.S. Department of Housing and Urban Development (HUD).

HUD’s proposed rule change would remove references to liability for housing discrimination that results from the effects of a policy, even if the policy was not intentionally discriminatory, the release said.

The coalition argues that discriminatory effects liability is essential for states to enforce both federal and state fair housing laws and to protect residents from policies that can create barriers to housing. Such claims are to challenge policies, including zoning ordinances, occupancy restrictions, no-pet rules, and English-only requirements, which can disproportionately harm marginalized groups.

Ford claims that removing these protections would make it more difficult for Nevada to address housing discrimination and send a false signal that certain unlawful practices are permissible.
