Nevada to Challenge Convicted Murderer, MS-13 Member’s Release

Federal prosecutors in Nevada announced they will seek further legal action following a court-ordered release of a convicted murderer and confirmed MS-13 gang member.

U.S. District Judge Richard F. Boulware II ordered the man’s release on January 22, despite objections from federal officials who warned of public safety risks. The man has a final order of removal from the United States.

“Our office remains committed to protecting public safety and enforcing the law,” said First Assistant U.S. Attorney Sigal Chattah. “In this matter, however, the outcome results in the release of a convicted murderer and known MS-13 gang member into the community, raising serious public-safety concerns. We are deeply troubled by the risks posed to the public and will continue to pursue all lawful avenues to address those concerns and safeguard the community.”

Federal authorities say the release conflicts with laws requiring individuals with final removal orders to remain in immigration custody to ensure removal and protect the public. While the man’s immigration case was pending, the U.S. Court of Appeals for the Ninth Circuit declined to block his removal, triggering mandatory detention under federal law.

Boulware was nominated by President Barack Obama and confirmed by the Senate in 2012.
