Nevada’s Legislative Overreach Threatens the State

In total disregard for the law, Nevada Secretary of State Frisco Aguilar and a dozen legislators are flouting constitutional provisions with impunity.

Article 4, Section 2 of Nevada’s constitution delineates that the legislature can only convene every other odd year for a maximum of 120 days. Yet, despite the absence of 2025 on our calendars, a group comprising at least 12 state senators and the Secretary of State are actively pushing for new laws and regulations, a brazen violation of established legislative norms.

Their justification for this egregious overreach? NRS 218E.150 (2022), a feeble legal fig leaf that fails to cover their transgressions.

The statute grants authority to create commissions during regular sessions, not conveniently sidestepping the constitutional limitations on legislative sessions. However, its application in this context is dubious and a mockery of all legal integrity.

This morning, at 9 a.m. on Monday, February 26, the proponents of this extra-constitutional power grab wasted no time pushing their agenda forward. Proposed measures include additional voter regulations and other issues outside lawful procedures.

The silence from the legal fraternity and opposition quarters is deafening. Where are the attorneys whose duty it is to uphold the rule of law and prevent such flagrant violations?

Nowhere to be found.

And where is the opposition to these self-appointed arbiters of our laws, who seem to believe themselves above the statutes they swore to uphold? Sadly, they are conspicuously absent, too.

The implications of this unchecked abuse of power are dire. By flouting constitutional provisions designed to safeguard democratic processes, these individuals undermine the foundation of our republic, which relies on adherence to the rule of law. And when those entrusted with its preservation become its greatest transgressors, the fabric of society begins to unravel.

The time for complacency has passed. Nevadans must rise and demand accountability from their elected officials lest we find ourselves prisoners of apathy, condemned to witness the erosion of the founding principles that built this great nation.
